Terms & Conditions
1. Parties and Scope
These Terms & Conditions ('Terms') govern all photography services provided by VanSkyStudio di Nathan Cohen ('Studio', 'we', 'us') to clients ('you', 'Client').
Services include wedding photography, editorial photography, portrait sessions, and related deliverables as described in the specific booking confirmation.
By signing a booking confirmation or paying a deposit, you accept these Terms in full.
2. Services
Wedding Photography: full-day or half-day coverage of ceremonies, receptions, and pre-wedding sessions. Deliverables specified in the booking confirmation.
Editorial Photography: concept-driven shoots for publications, brands, or commercial clients. Usage rights are defined separately in the Licensing Agreement.
Portrait Sessions: individual, couple, or family portrait sessions. Standard session duration is 90 minutes unless otherwise agreed.
All services are subject to availability and are confirmed only upon receipt of the deposit and signed booking confirmation.
3. Booking and Payment
A non-refundable deposit of 30% of the total fee is required to secure your date. The deposit is applied to the final invoice.
The remaining balance is due 7 days before the scheduled session or event date. Failure to pay the balance may result in cancellation with forfeiture of the deposit.
Payments are processed via SumUp (card) or bank transfer (IBAN provided on invoice). Invoices are issued in Euro (EUR).
Late payments beyond 14 days of the due date may incur interest at the legal rate set by Italian law (D.Lgs. 231/2002).
4. Cancellations and Rescheduling
Cancellations made more than 30 days before the session: deposit forfeited; no further charges.
Cancellations made within 30 days of the session: 50% of the remaining balance is due.
Cancellations made within 7 days of the session: 100% of the remaining balance is due.
Rescheduling is permitted with at least 48 hours' notice subject to availability. One complimentary reschedule is allowed; subsequent reschedules incur a €50 administration fee.
If the Studio must cancel due to illness, emergency, or force majeure, a full refund of all payments will be issued or a mutually agreed alternative date offered.
5. Copyright and Intellectual Property
The photographer retains all copyright in all photographs produced under this agreement, including the moral right of attribution.
Upon full payment, the Client receives a personal, non-exclusive, non-transferable licence to use the delivered images for personal, non-commercial purposes (printing, sharing with family and friends, social media) unless a commercial or extended licence is separately purchased.
The Studio reserves the right to use images for portfolio, website, social media, and editorial promotion unless the Client requests confidentiality in writing before the session.
Any commercial, editorial, or advertising use beyond the scope of the granted licence requires a separate written Licensing Agreement. See our Licensing Policy.
6. Liability
The Studio's total liability to the Client shall not exceed the total fee paid for the services under this contract.
The Studio is not liable for loss, damage, or failure to deliver caused by circumstances beyond our control, including equipment failure (where backup equipment has been deployed), illness where a substitute photographer of equivalent skill has been arranged, Acts of God, civil disturbances, or travel disruptions.
In the unlikely event that all photographic media is lost or irretrievably damaged, the Studio's liability is limited to a full refund of fees paid. No further compensation is payable.
The Client is responsible for ensuring all guests and subjects at the session have been informed that photography will take place.
7. Model Release
By engaging our services, the Client grants VanSkyStudio a royalty-free, worldwide licence to use images for portfolio and promotional purposes, subject to any written confidentiality request.
Third-party subjects (guests, models) must provide signed model releases where required. The Client is responsible for obtaining releases from third parties not part of the booked session subjects.
8. Governing Law and Disputes
These Terms are governed by Italian law. Any dispute arising out of or in connection with these Terms shall first be referred to mediation in accordance with Italian Legislative Decree 28/2010.
If mediation fails, disputes shall be subject to the exclusive jurisdiction of the Tribunale di Messina.
9. Amendments
We reserve the right to amend these Terms. Updates take effect 14 days after publication on our website. Existing bookings are governed by the Terms in force at the time of booking.
